세계 각국, 모든 사람의 모든 인권과 기본적 자유를 증진, 보호하는 데 유엔헌장의 목적과 원칙을 준수하는 것이 중요하다는 점을 재확인하고,
Reaffirming the importance of the observance of the purposes and principles of the Charter of the United Nations for the promotion and protection of all human rights and fundamental freedoms for all persons in all countries of the world,
인권 및 기본적 자유가 존중, 준수되도록 하기 위한 범세계적 노력에 세계인권선언과 인권에 관한 국제규약이 근간이 되며, 유엔체제 안에서 채택한 그 외 인권협약 과 지역 별 협약 역시 중요하다는 것을 재확인하며,
Reaffirming also the importance of the Universal Declaration of Human Rights and the International Covenants on Human Rights as basic elements of international efforts to promote universal respect for and observance of human rights and fundamental freedoms and the importance of other human rights instruments adopted within the United Nations system, as well as those at the regional level,
국제사회의 모든 일원이 인종, 피부색, 성별, 언어, 종교, 정치이념 및 기타 신념, 국적 또는 출신, 재산, 출생 및 기타 지위에 따른 어떤 구별도 없이 인권과 기본적 자유를 존중하는 숭고한 의무를 공동으로 또한 개별적으로 이행해야 한다는 점을 강조하고, 유엔헌장에 따라 이 의무를 수행하는 데 국가간 협력이 특히 중요하다는 것을 재확인하고,
Stressing that all members of the international community shall fulfil, jointly and separately, their solemn obligation to promote and encourage respect for human rights and fundamental freedoms for all without distinction of any kind, including distinctions based on race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status, and reaffirming the particular importance of achieving international cooperation to fulfil this obligation according to the Charter,
인종분리정책, 인종차별, 식민주의, 외세지배 또는 점유, 침략, 주권 민족단결 영토보전 등에 대한 위협이나, 국민의 자결권, 자산 및 천연자원에 대하여 완전한 주권을 행사할 수 있는 권리를 거부함으로써 야기되는 대대적, 노골적, 체계적 침해와 관련하여 국민과 개인의 인권 및 기본적 자유가 어떤 식으로든 침해되는 것을 효과적으로 철폐하는 데 국제협력이 중요하며 또한 이를 위하여 노력하는 개인이나 단체, 협회 등의 활동이 귀중하다는 것을 인정하고,
Acknowledging the important role of international cooperation for, and the valuable work of individuals, groups and associations in contributing to, the effective elimination of all violations of human rights and fundamental freedoms of peoples and individuals, including in relation to mass, flagrant or systematic violations such as those resulting from apartheid, all forms of racial discrimination, colonialism, foreign domination or occupation, aggression or threats to national sovereignty, national unity or territorial integrity and from the refusal to recognize the right of peoples to self-determination and the right of every people to exercise full sovereignty over its wealth and natural resources,
국제 평화와 안전은 인권 및 기본적 자유와 직결되어 있음을 인식하고 국제평화와 안전이 깨어졌다고 해서 이를 존중하지 않아도 된다는 것은 아니라는 점을 주지하면서,
Recognizing the relationship between international peace and security and the enjoyment of human rights and fundamental freedoms, and mindful that the absence of international peace and security does not excuse non-compliance,
모든 인권과 기본적 자유는 보편성을 가지며, 결코 분리할 수 없고, 상호 독립적이면서 동시에 서로 연관되어 있다는 사실과, 개별 권리나 자유를 행사하는 데 저해하지 않으면서 공정하고 형평성 있게 증진 및 보호해야 한다는 점을 재차 강조하고,
Reiterating that all human rights and fundamental freedoms are universal, indivisible, interdependent and interrelated and should be promoted and implemented in a fair and equitable manner, without prejudice to the implementation of each of those rights and freedoms,
인권 및 기본적 자유를 증진, 보호하는 주된 책임과 의무는 국가에 있다는 점을 강조하고,
Stressing that the prime responsibility and duty to promote and protect human rights and fundamental freedoms lie with the State,
개인, 단체, 협회도 국내외에서 인권 및 기본적 자유를 존중하고 이해를 증진할 권리와 책임이 있다는 것을 인식하면서,
Recognizing the right and the responsibility of individuals, groups and associations to promote respect for and foster knowledge of human rights and fundamental freedoms at the national and international levels,
다음과 같이 선언한다:
Declares :
제1조
Article 1
모든 사람은 단독으로 또는 다른 사람과 공동으로, 국내 또는 국제적 차원에서 인권 및 기본적 자유를 증진하고 이를 보호 및 실현하기 위하여 노력할 수 있는 권리를 가진다.
Everyone has the right, individually and in association with others, to promote and to strive for the protection and realization of human rights and fundamental freedoms at the national and international levels.
제2조
Article 2
1. 각국은, 특히 사회, 경제, 정치 등의 분야에서 필요한 모든 조건을 구축하고 관할 지역 내 모든 사람이 개별적으로 또는 다른 사람과 공동으로 모든 권리와 자유를 실제적으로 누릴 수 있도록 이를 법적으로 보장하는 데 필요한 조치를 취함으로써, 모든 인권과 기본적 자유를 보호, 증진, 이행할 주된 책임과 의무를 가진다.
1. Each State has a prime responsibility and duty to protect, promote and implement all human rights and fundamental freedoms, inter alia, by adopting such steps as may be necessary to create all conditions necessary in the social, economic, political and other fields, as well as the legal guarantees required to ensure that all persons under its jurisdiction, individually and in association with others, are able to enjoy all those rights and freedoms in practice.
2. 각국은 이 선언문에서 언급하는 권리 및 자유가 효과적으로 보장되도록 이에 필요한 입법, 행정 및 기타 조치를 취한다.
2. Each State shall adopt such legislative, administrative and other steps as may be necessary to ensure that the rights and freedoms referred to in the present Declaration are effectively guaranteed.
제3조
Article 3
인권 및 기본적 자유와 관련하여 유엔헌장 및 각국이 준수해야 하는 기타 국제적 의무 사항과 맥을 같이 하는 국내법은 인권과 기본적 자유를 시행 향유하며, 이 선언문에 언급된 인권 및 기본적 자유를 증진, 보호하고 효과적으로 실현하기 위한 모든 활동의 법적 기본틀이 된다.
Domestic law consistent with the Charter of the United Nations and other international obligations of the State in the field of human rights and fundamental freedoms is the juridical framework within which human rights and fundamental freedoms should be implemented and enjoyed and within which all activities referred to in the present Declaration for the promotion, protection and effective realization of those rights and freedoms should be conducted.
제4조
Article 4
이 선언문의 어떤 내용도 유엔헌장의 취지나 원칙을 훼손한다거나 이와 모순되는 것으로 해석하지 않으며, 세계인권선언, 인권에 관한 국제 규약, 기타 관련 국제협약 및 규정을 제한하거나 훼손하는 것으로 보지 아니한다.
Nothing in the present Declaration shall be construed as impairing or contradicting the purposes and principles of the Charter of the United Nations or as restricting or derogating from the provisions of the Universal Declaration of Human Rights, the International Covenants on Human Rights and other international instruments and commitments applicable in this field.
제5조
Article 5
인권 및 기본적 자유를 증진, 보호하기 위하여, 모든 사람은 단독으로 또는 다른 사람과 공동으로 다음과 같은 국내외적 권리를 가진다:
For the purpose of promoting and protecting human rights and fundamental freedoms, everyone has the right, individually and in association with others, at the national and international levels:
(a) 평화적 회합 또는 집회
a. To meet or assemble peacefully;
(b) 비정부기구, 협회, 또는 단체의 결성, 가입 및 참여
b. To form, join and participate in non-governmental organizations, associations or groups;
(c) 비정부 또는 정부간 기구와 의견 교환
c. To communicate with non-governmental or intergovernmental organizations.
제6조
Article 6
모든 사람은 단독으로 또는 다른 사람과 공동으로 다음과 같은 권리를 가진다:
Everyone has the right, individually and in association with others:
(a) 모든 인권 및 기본적 자유에 관한 정보를 파악, 조사, 입수, 수령, 보유할 수 있다. 예를 들어, 국내 입법, 사법 또는 행정 시스템에서 인권 및 기본적 자유가 어떻게 시행되고 있는지 그 실태에 관한 정보를 사용할 수 있다.
a. To know, seek, obtain, receive and hold information about all human rights and fundamental freedoms, including having access to information as to how those rights and freedoms are given effect in domestic legislative, judicial or administrative systems;
(b) 인권 및 기타 관련 국제 협약에서 규정하는 바와 같이, 모든 인권과 기본적 자유에 대한 의견, 정보, 지식을 다른 사람에게 자유롭게 발행, 제공 또는 배포할 수 있다.
b. As provided for in human rights and other applicable international instruments, freely to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms;
(c) 모든 인권 및 기본적 자유가 법적으로 또한 실제적으로 어떻게 준수되고 있는지 조사, 토의하고 이에 대하여 의견을 형성, 유지할 수 있으며, 이뿐 아니라 그 외 적절한 방법으로 통해서도 이 문제에 대하여 대중의 이목을 집중시킬 수 있다.
c. To study, discuss, form and hold opinions on the observance, both in law and in practice, of all human rights and fundamental freedoms and, through these and other appropriate means, to draw public attention to those matters.
제7조
Article 7
모든 사람은 단독으로 또는 다른 사람과 공동으로 인권에 관한 새로운 개념과 원칙을 개발, 논의하고 지지할 수 있는 권리를 가진다.
Everyone has the right, individually and in association with others, to develop and discuss new human rights ideas and principles and to advocate their acceptance.
제8조
Article 8
1. 모든 사람은 단독으로 또는 다른 사람과 공동으로 자국 정부의 운영 및 공공 업무 수행에 아무런 차별 없이 효과적으로 접근, 참여할 수 있는 권리를 가진다.
1. Everyone has the right, individually and in association with others, to have effective access, on a non-discriminatory basis, to participation in the government of his or her country and in the conduct of public affairs.
2. 특히 단독으로 또는 다른 사람과 공동으로, 정부부처 및 기구, 기타 공공기관에 업무활동에 대한 비판서나 업무향상을 위한 제안서를 제출하고, 인권 및 기본적 자유를 증진, 보호, 실현하는 데 방해 또는 저해가 되는 활동을 지적할 수 있다.
2. This includes, inter alia, the right, individually and in association with others, to submit to governmental bodies and agencies and organizations concerned with public affairs criticism and proposals for improving their functioning and to draw attention to any aspect of their work that may hinder or impede the promotion, protection and realization of human rights and fundamental freedoms.
제9조
Article 9
1. 인권과 기본적 자유를 행사함에 있어서, 예를 들어 이 선언문에 나와 있는 인권을 증진하고 보호하는 데 있어서, 모든 사람은 단독으로 또는 다른 사람과 공동으로, 효과적인 구제 수단을 이용하고 인권이 침해될 경우 보호받을 수 있는 권리를 가진다.
1. In the exercise of human rights and fundamental freedoms, including the promotion and protection of human rights as referred to in the present Declaration, everyone has the right, individually and in association with others, to benefit from an effective remedy and to be protected in the event of the violation of those rights.
2. 권리나 자유가 침해된 자는 직접 또는 법적으로 승인된 대리인을 통해 독립적이며 형평성을 유지하는 관할 사법당국이나 법으로 설립된 기타 관계 당국에 제소하여 공청회를 통해 즉시 사건 조사가 진행되도록 하고, 당사자의 인권이나 자유가 침해된 경우, 판결을 통해 법에 의거한 배상금 등 시정 방안을 제시받고, 최종 결정 사항 및 배상이 지체없이 실행되도록 할 수 있는 권리를 가진다.
2. To this end, everyone whose rights or freedoms are allegedly violated has the right, either in person or through legally authorized representation, to complain to and have that complaint promptly reviewed in a public hearing before an independent, impartial and competent judicial or other authority established by law and to obtain from such an authority a decision, in accordance with law, providing redress, including any compensation due, where there has been a violation of that person's rights or freedoms, as well as enforcement of the eventual decision and award, all without undue delay.
3. 이를 위하여, 모든 사람은 단독으로 또는 다른 사람과 공동으로, 특히 다음과 같은 권리를 가진다:
3. To the same end, everyone has the right, individually and in association with others, inter alia :
(a) 인권 및 기본적 자유에 대한 침해와 관련하여, 관리 또는 정부 기구가 시행하는 정책 및 조치에 관하여, 청원 등 적절한 방법으로 관할 사법, 행정 또는 입법부, 혹은 해당국 법률 시스템에서 규정하는 기타 관할 당국에 이의를 제기할 수 있다. 일단 이의가 제기되면 부당하게 지체하지 않고 판결하여야 한다.
a. To complain about the policies and actions of individual officials and governmental bodies with regard to violations of human rights and fundamental freedoms, by petition or other appropriate means, to competent domestic judicial, administrative or legislative authorities or any other competent authority provided for by the legal system of the State, which should render their decision on the complaint without undue delay;
(b) 공청회, 소송, 재판 등에 참석하여 국내법 및 관련 국제 의무 규정과 조약을 준수하였다는 여론을 형성할 수 있다.
b. To attend public hearings, proceedings and trials so as to form an opinion on their compliance with national law and applicable international obligations and commitments;
(c) 인권 및 기본적 자유를 옹호하는 데 전문적인 법률지원 서비스와 기타 관련 자문 서비스 및 지원을 제안 및 제공한다.
c. To offer and provide professionally qualified legal assistance or other relevant advice and assistance in defending human rights and fundamental freedoms.
4. 마찬가지로, 모든 사람은 관련 국제협약 및 절차에 따라, 단독으로 또는 다른 사람과 공동으로 인권 및 기본적 자유와 관련된 문제에 대하여 청원을 접수, 심사할 수 있는 일반 또는 전문 국제기구를 자유롭게 접촉하여 의견을 교환할 수 있는 권리를 가진다.
4. To the same end, and in accordance with applicable international instruments and procedures, everyone has the right, individually and in association with others, to unhindered access to and communication with international bodies with general or special competence to receive and consider communications on matters of human rights and fundamental freedoms.
5. 국가는 관할 영토내에서 인권과 기본적 자유가 침해되었다고 확신할 만한 합리적 근거가 있는 경우, 신속 공정하게 수사를 진행하거나 심리가 진행되도록 한다.
5. The State shall conduct a prompt and impartial investigation or ensure that an inquiry takes place whenever there is reasonable ground to believe that a violation of human rights and fundamental freedoms has occurred in any territory under its jurisdiction.
제10조
Article 10
어떤 사람도 작위 또는 부작위로 인권 및 기본적 자유를 침해하는 데 가담할 수 없으며, 가담을 거절했다고 해서 어떤 처벌이나 불이익을 받을 수 없다.
No one shall participate, by act or by failure to act where required, in violating human rights and fundamental freedoms and no one shall be subjected to punishment or adverse action of any kind for refusing to do so.
제11조
Article 11
모든 사람은 단독으로 또는 다른 사람과 공동으로, 자신의 직무나 직업을 합법적으로 수행할 수 있는 권리를 가진다. 모든 사람은 자신의 직업으로 인하여 다른 사람에 대한 인간으로서의 존엄성, 인권, 기본적 자유에 영향을 미칠 수 있는 경우, 그 권리와 자유를 존중하고 직업윤리 및 강령에 대한 국내외 관련 기준을 준수한다.
Everyone has the right, individually and in association with others, to the lawful exercise of his or her occupation or profession. Everyone who, as a result of his or her profession, can affect the human dignity, human rights and fundamental freedoms of others should respect those rights and freedoms and comply with relevant national and international standards of occupational and professional conduct or ethics.
제12조
Article 12
1. 모든 사람은 단독으로 또는 다른 사람과 공동으로, 인권 및 기본적 자유가 침해되는 것을 막기 위한 평화적 활동에 참여할 수 있다.
1. Everyone has the right, individually and in association with others, to participate in peaceful activities against violations of human rights and fundamental freedoms.
2. 국가는 이 선언문에 언급된 권리를 합법적으로 행사했다는 이유로 받게 되는 어떤 폭력이나 위협, 보복, 사실상 또는 법률상의 불이익, 압력, 기타 자의적 행위로부터 관할 당국이 모든 사람을 단독으로 또는 다른 사람과 공동으로 보호할 수 있도록 하는 데 필요한 모든 조치를 취한다.
2. The State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration.
3. 이와 관련하여, 모든 사람은 단독으로 또는 다른 사람과 공동으로, 국가에 귀책 사유가 있는 활동, 작위 또는 부작위로 인하여 인권 및 기본적 자유가 침해되었거나, 단체나 개인이 자행한 폭력 행위로 인권 및 기본적 자유가 침해된 경우, 이에 대하여 평화적인 방법으로 대응하거나 반대 활동을 벌이는 데 있어서 국내법에 의하여 효과적으로 보호를 받을 수 있다.
3. In this connection, everyone is entitled, individually and in association with others, to be protected effectively under national law in reacting against or opposing, through peaceful means, activities and acts, including those by omission, attributable to States that result in violations of human rights and fundamental freedoms, as well as acts of violence perpetrated by groups or individuals that affect the enjoyment of human rights and fundamental freedoms.
제13조
Article 13
모든 사람은 단독으로 또는 다른 사람과 공동으로, 이 선언문 제3조에 의하여 평화적인 방법으로 인권과 기본적 자유를 증진, 보호한다는 명백한 목적에 자원을 요청, 수령, 사용할 수 있는 권리를 가진다.
Everyone has the right, individually and in association with others, to solicit, receive and utilize resources for the express purpose of promoting and protecting human rights and fundamental freedoms through peaceful means, in accordance with article 3 of the present Declaration.
제14조
Article 14
1. 국가는 입법, 사법, 행정, 기타 적절한 조치를 통하여 시민, 정치, 경제, 사회, 문화적 권리에 대한 모든 국민의 이해를 증진시킬 책임이 있다.
1. The State has the responsibility to take legislative, judicial, administrative or other appropriate measures to promote the understanding by all persons under its jurisdiction of their civil, political, economic, social and cultural rights.
2. 특히 다음과 같은 방법을 사용한다:
2. Such measures shall include, inter alia :
(a) 국내 법령 및 관련 기본 국제인권 협약을 발간하여 널리 배포한다.
a. The publication and widespread availability of national laws and regulations and of applicable basic international human rights instruments;
(b) 국제인권 조약에 의하여 설립된 기구에 그 조약 가입국으로서 제출하는 정규 보고서, 동 기구에서 토의된 내용에 대한 요약서 및 공식 보고서 등, 인권에 관한 국제 문서 역시 국내 문서와 마찬가지로 빠짐없이 모두 공개한다.
b. Full and equal access to international documents in the field of human rights, including the periodic reports by the State to the bodies established by the international human rights treaties to which it is a party, as well as the summary records of discussions and the official reports of these bodies.
3. 국가는 관할 영토에서 인권과 기본적 자유를 증진 보호하기 위하여, 옴부즈맨, 인권위원회 등과 같은 형태로 독립적인 국가 기관이 설립 발전되도록 하며, 가능하면 이를 지원한다.
3. The State shall ensure and support, where appropriate, the creation and development of further independent national institutions for the promotion and protection of human rights and fundamental freedoms in all territory under its jurisdiction, whether they be ombudsmen, human rights commissions or any other form of national institution.
제15조
Article 15
국가는 각급 학교에서 인권 및 기본적 자유에 대한 교육을 증진시키고, 변호사, 경찰, 군인, 공무원을 대상으로 하는 교육 프로그램에 인권 교육이 적절히 포함되도록 할 책임이 있다.
The State has the responsibility to promote and facilitate the teaching of human rights and fundamental freedoms at all levels of education and to ensure that all those responsible for training lawyers, law enforcement officers, the personnel of the armed forces and public officials include appropriate elements of human rights teaching in their training programme.
제16조
Article 16
개인, 비정부기구 및 기타 관련기관은 인권과 기본적 자유에 대한 교육, 훈련, 연구 활동을 통하여, 해당 사회 및 지역사회의 다양한 배경을 고려하고 특히 국가간이나 인종과 종교 단체간에 상호 이해, 인내, 평화, 친선관계를 강화하는 등, 인권 및 기본적 자유에 관한 국민 의식을 제고하는 데 중요한 역할을 담당하고 있다.
Individuals, non-governmental organizations and relevant institutions have an important role to play in contributing to making the public more aware of questions relating to all human rights and fundamental freedoms through activities such as education, training and research in these areas to strengthen further, inter alia , understanding, tolerance, peace and friendly relations among nations and among all racial and religious groups, bearing in mind the various backgrounds of the societies and communities in which they carry out their activities.
제17조
Article 17
이 선언문에 언급된 권리와 자유를 행사함에 있어서 모든 사람은 단독으로 또는 다른 사람과 공동으로, 다른 사람의 권리와 자유를 충분히 인식 존중하고 민주사회에서 요구하는 도덕성, 공공질서, 일반복지에 관한 조건을 충족하기 위하여 관련 국제 의무 규정에 따라, 법으로 정한 제한 사항을 준수하여야 한다.
In the exercise of the rights and freedoms referred to in the present Declaration, everyone, acting individually and in association with others, shall be subject only to such limitations as are in accordance with applicable international obligations and are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society.
제18조
Article 18
1. 모든 사람에게는, 자유롭고 완전하게 인격을 개발할 수 있는 지역 사회에 대하여, 또한 그 지역사회 내에서 수행해야 할 의무가 있다.
1. Everyone has duties towards and within the community, in which alone the free and full development of his or her personality is possible.
2. 개인, 단체, 기관, 비정부기구에는 민주주의를 보호하고 인권과 기본적 자유를 증진하며, 민주사회, 체제, 과정을 증진, 발전시키는 데 중요한 역할과 책임이 있다.
2. Individuals, groups, institutions and non-governmental organizations have an important role to play and a responsibility in safeguarding democracy, promoting human rights and fundamental freedoms and contributing to the promotion and advancement of democratic societies, institutions and processes.
3. 또한, 개인, 단체, 기관, 비정부기구에는 세계인권선언 및 기타 인권협약이 규정하는 권리와 자유가 완전하게 실현되는 데 필요한, 모든 사람의 국내외 질서 유지권을 증진하는 데 중요한 역할과 책임이 있다.
3. Individuals, groups, institutions and non-governmental organizations also have an important role and a responsibility in contributing, as appropriate, to the promotion of the right of everyone to a social and international order in which the rights and freedoms set forth in the Universal Declaration of Human Rights and other human rights instruments can be fully realized.
제19조
Article 19
이 선언문의 어떤 규정도 개인, 단체, 사회기관, 또는 국가가 이 선언에 언급된 권리와 자유를 파괴할 목적으로 어떤 활동에 관여하거나 어떤 행위를 수행할 권리를 가진다는 의미로 해석할 수 없다.
Nothing in the present Declaration shall be interpreted as implying for any individual, group or organ of society or any State the right to engage in any activity or to perform any act aimed at the destruction of the rights and freedoms referred to in the present Declaration.
제20조
Article 20
이 선언문의 어떤 규정도 국가가 유엔헌장 규정에 반하여 개인, 단체, 기관, 또는 비정부기구의 활동을 조언, 조장하는 것을 허용할 수 있다는 의미로 해석할 수 없다.
Nothing in the present Declaration shall be interpreted as permitting States to support and promote activities of individuals, groups of individuals, institutions or non-governmental organizations contrary to the provisions of the Charter of the United Nations.
