난민의 지위에 관한 의정서
Article 1. General provision
제1조 총 칙
1. The States Parties to the present Protocol undertake to apply articles 2 to 34 inclusive of the Convention to refugees as hereinafter defined.
1. 이 의정서의 당사국은 이하에서 정의된 난민에 대하여 협약의 제2조에서 제34조까지를 적용할 것을 약속한다.
2. For the purpose of the present Protocol, the term "refugee" shall, except as regards the application of paragraph 3 of this article, mean any person within the definition of article I of the Convention as if the words "As a result of events occurring before 1 January 1951 and..." and the words "...as a result of such events", in article 1 A (2) were omitted.
2. 이 의정서의 적용상, "난민"이라는 용어는, 이 조 제3항의 적용에 관한 것을 제외하고, 협약 제1조 A(2)에서 "1951년 1월 1일 전에 발생한 사건의 결과로서 또한…"이라는 표현과 "… 그러한 사건의 결과로서"라는 표현이 생략되어 있는 것으로 볼 경우 협약 제1조의 정의에 해당하는 모든 자를 말한다.
3. The present Protocol shall be applied by the States Parties hereto without any geographic limitation, save that existing declarations made by States already Parties to the Convention in accordance with article I B (I) (a) of the Convention, shall, unless extended under article I B (2) thereof, apply also under the present Protocol.
3. 이 의정서는 이 의정서의 당사국에 의하여 어떠한 지리적 제한도 없이 적용된다. 다만, 이미 협약의 당사국이 된 국가로서 협약 제1조 B(1) (a)를 적용한다는 선언을 행하고 있는 경우에 그 선언은 동 조 B(2)에 따라 그 국가의 의무가 확대되지 아니하는 한, 이 의정서 하에서도 적용된다.
Article 2. Co-operation of the national authorities with the United Nations
제2조 국내당국과 국제연합과의 협력
1. The States Parties to the present Protocol undertake to co-operate with the Office of the United Nations High Commissioner for Refugees, or any other agency of the United Nations which may succeed it, in the exercise of its functions, and shall in particular facilitate its duty of supervising the application of the provisions of the present Protocol.
1. 이 의정서의 당사국은 국제연합 난민고등판무관 사무국 또는 이를 승계하는 국제연합의 다른 기관의 임무 수행에 있어서 이들 기관과 협력할 것을 약속하고, 특히 이들 기관이 이 의정서 규정의 적용을 감독하는 책무의 수행에 있어서 이들 기관에 편의를 제공한다.
2. In order to enable the Office of the High Commissioner or any other agency of the United Nations which may succeed it, to make reports to the competent organs of the United Nations, the States Parties to the present Protocol undertake to provide them with the information and statistical data requested, in the appropriate form, concerning:
2. 이 의정서의 당사국은 국제연합 난민고등판무관 사무국 또는 이를 승계하는 국제연합의 다른 기관이 국제연합의 관할기관에 보고하는 것을 용이하게 하기 위하여 요청에 따라 다음 사항에 관한 정보와 통계자료를 적당한 양식으로 제공할 것을 약속한다.

Article 3. Information on national legislation
제3조 국내법령에 관한 정보
The States Parties to the present Protocol shall communicate to the Secretary-General of the United Nations the laws and regulations which they may adopt to ensure the application of the present Protocol.
이 의정서의 당사국은 국제연합 사무총장에게 이 의정서의 적용을 확보하기 위하여 제정하는 법령을 송부한다.
Article 4. Settlement of disputes
제4조 분쟁의 해결
Any dispute between States Parties to the present Protocol which relates to its interpretation or application and which cannot be settled by other means shall be referred to the International Court of Justice at the request of any one of the parties to the dispute.
이 의정서의 해석 또는 적용에 관한 이 의정서 당사국간의 분쟁으로서 다른 방법에 의하여 해결될 수 없는 것은 분쟁당사국중 어느 일 당사국의 요청에 의하여 국제사법재판소에 부탁된다.
Article 5. Accession
제5조 가 입
The present Protocol shall be open for accession on behalf of all States Parties to the Convention and of any other State Member of the United Nations or member of any of the specialized agencies or to which an invitation to accede may have been addressed by the General Assembly of the United Nations. Accession shall be effected by the deposit of an instrument of accession with the Secretary-General of the United Nations.
이 의정서는 협약의 모든 당사국과 이들 당사국 이외의 국가로서 국제 연합 또는 국제연합 전문기구의 회원국 또는 국제연합 총회에 의하여 이 의정서에 가입하도록 초청받은 국가에 의한 가입을 위하여 개방된다. 가입은 가입서를 국제연합 사무총장에게 기탁함으로써 이루어진다.
Article 6. Federal clause
제6조 연방조항
In the case of a Federal or non-unitary State, the following provisions shall apply:
연방제 또는 비단일제 국가인 경우에는 다음 규정을 적용한다.
(a) With respect to those articles of the Convention to be applied in accordance with article I, paragraph 1, of the present Protocol that come within the legislative jurisdiction of the federal legislative authority, the obligations of the Federal Government shall to this extent be the same as those of States Parties which are not Federal States;
(a) 이 의정서의 제1조 제1항에 따라 적용되는 협약의 규정으로서 이들 규정의 실시가 연방의 입법기관의 입법권의 범위내에 속하는 것에 관하여서는, 연방 정부의 의무는 연방제를 취하고 있지 아니하고 있는 이 의정서의 당사국의 의무와 동일한 것으로 한다.
(b) With respect to those articles of the Convention to be applied in accordance with article I, paragraph 1, of the present Protocol that come within the legislative jurisdiction of constituent States, provinces or cantons which are not, under the constitutional system of the Federation, bound to take legislative action, the Federal Government shall bring such articles with a favourable recommendation to the notice of the appropriate authorities of States, provinces or cantons at the earliest possible moment;
(b) 이 의정서의 제1조 제1항에 따라 적용되는 협약의 규정으로서 이들 규정의 실시가 구성국, 주 또는 현의 입법권의 범위내에 속하고 또한 연방의 헌법제도상 구성국, 주 또는 현이 입법 조치를 취할 의무가 없는 것에 관하여, 연방정부는 구성국, 주 또는 현의 적당한 기관에 대하여 가능한 한 빠른 시기에 호의적인 권고와 함께 그 규정을 통보한다.
(c) A Federal State Party to the present Protocol shall, at the request of any other State Party hereto transmitted through the Secretary-General of the United Nations, supply a statement of the law and practice of the Federation and its constituent units in regard to any particular provision of the Convention to be applied in accordance with article I, paragraph 1, of the present Protocol, showing the extent to which effect has been given to that provision by legislative or other action.
(c) 이 의정서의 당사국인 연방제 국가는, 이 의정서의 기타 당사국으로부터 국제연합 사무총장을 통한 요청이 있는 경우, 제1조 제1항에 따라 적용되는 협약 규정의 실시에 관한 연방과 그 구성단위의 법령 및 관행에 관한 설명을 제공하고, 입법 기타의 조치에 의하여 이들 규정이 실시되고 있는 정도를 제시한다.
Article 7. Reservations and declarations
제7조 유보와 선언 1 )
1. At the time of accession, any State may make reservations in respect of article IV of the present Protocol and in respect of the application in accordance with article I of the present Protocol of any provisions of the Convention other than those contained in articles 1, 3, 4, 16(1) and 33 thereof, provided that in the case of a State Party to the Convention reservations made under this article shall not extend to refugees in respect of whom the Convention applies.
1. 어떠한 국가도 이 의정서에 가입시 이 의정서 제4조에 관하여, 또한 협약의 제1조, 제3조, 제4조, 제16조 제1항 및 제33조 규정을 제외하고 이 의정서의 제1조에 따를 협약 규정의 적용에 관하여 유보할 수 있다. 다만, 협약의 당사국이 이 조에 따라 행한 유보는 협약의 적용을 받는 난민에게는 미치지 아니한다.
2. Reservations made by States Parties to the Convention in accordance with article 42 thereof shall, unless withdrawn, be applicable in relation to their obligations under the present Protocol.
2. 협약 제42조에 따라 협약의 당사국이 협약에 대하여 행한 유보는 철회되지 아니하는 한 이 의정서에 따른 의무에 관하여서도 적용된다.
3. Any State making a reservation in accordance with paragraph I of this article may at any time withdraw such reservation by a communication to that effect addressed to the Secretary- General of the United Nations.
3. 이 조 제1항에 따라 유보를 행한 국가는 국제연합 사무총장에 대한 통고로써 당해 유보를 언제든지 철회할 수 있다.
4. Declarations made under article 40, paragraphs I and 2, of the Convention by a State Party thereto which accedes to the present Protocol shall be deemed to apply in respect of the present Protocol, unless upon accession a notification to the contrary is addressed by the State Party concerned to the Secretary-General of the United Nations. The provisions of article 40, paragraphs 2 and 3, and of article 44, paragraph 3, of the Convention shall be deemed to apply muratis mutandis to the present Protocol.
4. 협약의 당사국으로서 이 의정서에 가입한 국가가 협약 제40조 제1항 또는 제2항에 따라 행한 선언은, 가입시 당해당사국이 국제연합 사무 총장에게 반대의 통고를 하지 아니하는 한, 이 의정서에 관하여도 적용되는 것으로 간주된다. 협약 제40조 제2항과 제3항 및 제44조 제3항의 규정은 이 의정서에 준용된다.
Article 8. Entry into Protocol
제8조 발 효
1. The present Protocol shall come into force on the day of deposit of the sixth instrument of accession.
1. 이 의정서는 여섯번째의 가입서가 기탁된 날에 발효한다.
2. For each State acceding to the Protocol after the deposit of the sixth instrument of accession, the Protocol shall come into force on the date of deposit by such State of its instrument of accession.
2. 이 의정서는 여섯번째의 가입서가 기탁된 후 가입하는 국가에 대하여는 그 가입서가 기탁된 날에 발효한다.
Article 9. Denunciation
제9조 폐 기
1. Any State Party hereto may denounce this Protocol at any time by a notification addressed to the Secretary-General of the United Nations.
1. 이 의정서의 어떠한 당사국도 국제연합 사무총장에 대한 통고로써 이 의정서를 언제든지 폐기할 수 있다.
2. Such denunciation shall take effect for the State Party concerned one year from the date on which it is received by the Secretary-General of the United Nations.
2. 폐기는 국제연합 사무총장이 통고를 접수한 날로부터 1년후에 관계당사국에 대하여 효력을 발생한다.
Article 10. Notifications by the Secretary-General of the United Nations
제10조 국제연합 사무총장에 의한 통보
The Secretary-General of the United Nations shall inform the States referred to in article V above of the date of entry into force, accessions, reservations and withdrawals of reservations to and denunciations of the present Protocol, and of declarations and notifications relating hereto.
국제연합 사무총장은 상기 제5조에 규정하는 국가에 대하여 이 의정서의 발효일자, 가입, 유보, 유보의 철회, 폐기 및 이에 관계된 선언 및 통고를 통보한다.
Article 11. Deposit in the archives of the Secretariat of the United Nations
제11조 국제연합 사무국 문서보존소에의 기탁
A copy of the present Protocol, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, signed by the President of the General Assembly and by the Secretary-General of the United Nations, shall be deposited in the archives of the Secretariat of the United Nations. The Secretary-General will transmit certified copies thereof to all States Members of the United Nations and to the other States referred to in article 5 above.
중국어, 영어, 불란서어, 러시아어 및 서반아어본이 동등히 정본인 이 의정서의 본서는, 국제연합 총회의장과 사무총장이 서명한 후 국제연합 사무국 문서보존소에 기탁된다. 사무총장은 그 인증등본을 국제연합의 모든 회원국과 상기 제5조에 규정하는 기타 국가들에게 송부한다.
